A good courtroom holding a sensitive case with the intelligent prosecutor and defendant arguing, counter-arguing, and further counterarguing. The rounds of evidence with each round changing the suspects. And finally a good emotional set of personalities settled in the courtroom. A scene like this is simply one of the most attention-grabbing scenes for a normal curious and usually free person. It gnaws on one’s heart. And that one knows it’s impossible to sleep or concentrate to the fullest if they don’t see the conclusion of that courtroom. What makes it so attention-grabbing? Why do people get sleepless nights after an unfinished episode of prosecuting and defense attorney?
The offense and defense
It has been a long assumed fact. On every wrong turn, there would be that cross of an angel and devil in one’s mind. So let’s just state it. It is actually this presence of prosecutor and defender, the good and evil, not respectively, in the courtroom that makes us this hooked up to a traditional courtroom in any movie or video. The itch to understand and know the conclusion in a case is proven to be the culprit that is guilty of being responsible for the sleepless nights of countless curious people.
Roles
Each lawsuit has a specific prosecutor and defendant assigned to it. Here the prosecutor is the one who files in the case. Therefore, the prosecutor is responsible for prosecuting the accused person. Hence, this person needs to gather information and evidence to determine if the case can be proven and then persuade the jury to determine the defendant as guilty. On the other hand, the defense lawyer is the complete opposite. This person tries to overturn the evidence put up by the prosecuting attorney.
Employer
A prosecutor is usually a public officer who represents the office of an attorney. This federal prosecutor is funded by public money and employed by the Department of Justice. The defense attorney, on the other hand, is usually a private one. The cases where a public defender gets appointed arise when the defendant is unable to provide for a lawyer.
Requirements to win the case
The major difference between the prosecutor and defendant arises when the case starts. Since the beginning, the defendant has the advantage of the innocent until proven guilty rule. That is, the defendant can win the case till there is no presence of concrete evidence against them. This gives the starting ball of the case to the prosecutor. From the start, the prosecutor needs to compile and bring forward evidence to persuade the jury about the crimes of the defendant within a reasonable standard. In case of a failed attempt, the case would be dismissed and would end without further hearing. Thus, prior work i.e., research, collecting evidence, and compiling them is necessary before moving on to prosecute a person.
