Texas has been part of the Driver Responsibility Program since 2003. This program monitors the driving habits of Texas residents in an attempt to punish drivers considered to “high risk.” However, the program hasn’t always worked the way as planned. In many instances, due to community service and time served laws for traffic tickets, many low income families have been hit the hardest by the program. The Texas Indigency Program For Surcharges
The indigency program for surcharges are based on evaluation of the income level of the individual. The chart used to determine level of income is as follows:

The official statement from DPS regarding the indigency program is as follows:

Indigency Program
The Texas Legislature authorized the Indigency Program to give individuals the opportunity to have surcharges owed waived under the Driver Responsibility Program and maintain their driving privileges.
For individuals who apply and qualify, the Indigency Program:
- Waives only the surcharge amount owed, and
- Stops the surcharge suspension for those individuals who are approved for the program; individuals who have an enforcement action other than a surcharge suspension are still not eligible to drive.
Individuals who participate in this program will still owe the full amount of all other applicable fees, including reinstatement fees.
Apply for Indigency
To apply for indigency, individuals must submit an application and provide supporting documentation. An application must be fully completed, signed before it can be processed.

The Texas Incentive Program
The Texas Incentive Program for surcharges is different in that it does not rely as heavily on the income level of the individual request a reduction in the surcharges. The official word from DPS regarding this program is as follows:
- The Texas Legislature authorized the Incentive Program to give individuals the opportunity to pay surcharges owed under the Driver Responsibility Program and still maintain their driving privileges.For individuals who qualify, the Incentive Program:
- Reduces only the surcharge amount owed to 50 percent of the total plus related fees, and
- Stops the surcharge suspension for those individuals who are making payments; individuals who have an enforcement action other than a surcharge suspension are still not eligible to drive.
Individuals who participate in this program will still owe the full amount of all other applicable fees, including reinstatement fees and service fees.

The cold hard facts are that surcharges are expensive and can drain your bank account.
