The Meaning of The Words “Appearance” and “Bond”
An appearance bond is a document that is filed by a lawyer to remove warrants that have been issued by the court for those cases going past their appearance date. But what is an appearance bond? The document is literally self described. For example, the word “bond” simply means to promise. So an appearance bond means the attorney is filing a sworn document promising to appear on your behalf. This promise is backed by a financial commitment to your case. The financial commitment is equal to the full amount of the fine that was owed to the court.
How Are Warrants Issued For Tickets?
It is important to remember how your case went into warrant in the first place. A ticket cannot go into warrant without a person missing their appearance date. Every ticket issued gives a person a date certain in which to contact the court. If this date is missed, then the court can take action to forcefully bring that person before the court to resolve the case. This is the only way a warrant can be issued for a class “c” ticket.
Attending Future Court Dates After The Appearance Bond Is Accepted
The appearance bond itself simply promises that an attorney will not miss any new court dates that were previously missed by the client. The attorney has to swear under oath that if a court date is missed in the future, they can be sued for the full amount of the fine. So the attorney is now incentivized to appear on your behalf and the court has the security of knowing that if a date is missed, the attorney will have to pay for the mistake.
Appearance Bonds Are Contracts
So in short, the appearance bond is nothing more than a contract between the court and your lawyer to make a previous wrong right. That previous wrong being the client missing their initial appearance date commitment. No actual money exchanges hands based on this promise if, when the court reschedules the court date, the attorney appears on the client’s behalf to resolve the case. Once the case is resolved, the promise made by the lawyer to appear in court is completed. The bond is then released and the client must then complete any conditions set by the court as they were negotiated by the lawyer.
