THE PROBLEM:
The toll authority was just granted approval by the Texas legislature to “farm out” collection services to a collection law firm by the name of Linebarger Goggan Blair & Sampson. This collection agency is authorized by the Toll Road Authority to attempt to collect any outstanding toll road fees owed to the NTTA. Many people are already getting calls from this collection agency in regard to their toll violations. The result of these conversations are very sobering. Linebarger has incentive to collect as much as possible because it is paid based on the amount of revenue generated. For this reason, the normal reductions that can be worked out with NTTA are not being discussed with people who have outstanding tolls. They are also telling people that they will refer the case back to NTTA to file criminal charges against the alleged violator so that a warrant can be issued for the arrest of that person. This type of collection tactic for any other type of debt would be considered a violation of the Fair Debt Collection Practices Act.
WHAT SHOULD BE DONE:
Call their bluff. Don’t give Linebarger a single red cent. Tell them that they need to refer the cases back to the NTTA. NTTA will then file a class “c” misdemeanor against the toll violator. At that point an attorney can go in and lift the warrant. Once the warrant is lifted the traffic ticket attorney can then negotiate a lower fee payable to NTTA directly. This lower fee usually only amounts the actual amount of the tolls that were run. For example, our traffic ticket lawyers have seen cases as high as $50,000.00 be reduced to the original amount of $2500.00. Just recently our ticket lawyers negotiated a deal in JP 3-2 Dallas County where the clients outstanding balance was reduced from $2800.00 to $253.00. The client had 4 toll road violations that were filed in this court. 3 out of the 4 violations were dismissed as well.
CONCLUSION:
Do not allow the legislature to create a bigger bully than is necessary to collect to tolls. This alliance the NTTA has entered into with Linebarger Goggan Blair and Sampson is incentive by greed, not by any real measure of fairness. The best deal you are going to get is by negotiating directly with NTTA, not through a collection agency. Traffic ticket attorneys are still able to do this at a very high rate of success.
I got a toll road ticket thru the mail. It had the right vehicle plate numbers on the ticket but I knew I had not been on that road for years. I asked my wife and also she said no. I paid the ticket anyway with a money order becuase I did not want problems in the future. I emailed them to send me a picture of the vehicle with my plates on them. I was getting very stressed out someone had a copy of my plates and robbing banks, or stores or doing evil things. IN a few days I got a reply from them to forget the ticket. I was very confused and called them. I gave the ref. ticket number and plate numbers. Lady on phone said they made a mistake and got the wrong plates. I was very upset they would not take the time to make sure they were sending out the ticket to the right plate number. She hanged up on me. Til this day I aslo have not received money order. My question is, do I have a case to sue them for being very sloppy with thier work and putting a person thru such a stressful ordeal? NOt to mention accusing my wife of having an affair behind my back. Thanks, any feedback appreciated.
